About these terms

These Terms and Conditions ("Terms") govern your use of the website www.ibiza-yacht-rental.com ("the Site") and any charter services arranged through it.

The Site is operated by Ibiza Yacht Rental, trade name of Mark Parrett (NIE X4344481B), sole proprietor with registered address at Calle Juan Alonso Rudian 4 1-4, 07800, Ibiza, Spain ("we", "us", "our").

By using the Site or submitting an enquiry or booking petition, you agree to these Terms. If you do not agree, do not use the Site.

What we do

We arrange private yacht and boat charters in Ibiza and Formentera. Depending on the vessel, we operate either as broker (agent for the vessel operator) or as principal (the contracting party for the charter). The role applicable to your specific booking is identified in your booking confirmation.

The specific operational terms of each charter — including payment schedule, cancellation conditions, security deposit, and on-board rules — are set out in the Hire Conditions provided to you as part of the booking process and form part of your charter contract.

Enquiries and booking petitions

Submitting an enquiry

Submitting an enquiry through the Site does not constitute a booking and creates no obligation on either party. An enquiry is a request for information or a charter proposal.

Booking petition

A booking petition is a formal request to proceed with a specific charter on specific dates. Submitting a petition does not confirm a booking — it initiates a review and confirmation process.

A booking is only confirmed once you have received written confirmation from us and any required deposit has been received.

Pricing and VAT

All prices displayed on the Site are inclusive of Spanish VAT (IVA) at the applicable rate, unless stated otherwise. Fuel, port fees, marina charges, food and drink, watersports extras, and additional crew are charged separately unless explicitly included. We will always provide a clear written summary of what is and is not included before you confirm a booking.

Payment

Payment terms for your charter — including amount, timing, and accepted methods — are set out in the Hire Conditions and in your booking confirmation.

Cancellation and changes

Cancellation by you

Cancellation terms are set out in the Hire Conditions provided at booking and depend on the payment option you select (e.g. standard or non-refundable). We strongly recommend obtaining appropriate travel and charter cancellation insurance.

Cancellation by us

In the unlikely event that a confirmed charter cannot proceed due to vessel unavailability, weather, or other reasons attributable to us or the vessel operator, the protections set out in the Hire Conditions apply.

Changes to bookings

Changes to confirmed bookings are subject to availability and approval. Change requests must be made in writing to info@ibiza-yacht-rental.com.

No 14-day right of withdrawal

Charter services contracted for a specific date or period are excluded from the 14-day right of withdrawal under Article 103.l of Spanish consumer law (Real Decreto Legislativo 1/2007). You cannot cancel a confirmed booking under that right. The applicable cancellation terms are those set out in the Hire Conditions.

Your responsibilities

By confirming a charter, you agree:

  • To provide accurate information about the number of guests, their ages, and any specific requirements

  • That the number of guests will not exceed the maximum capacity specified for the vessel

  • To follow the instructions of the skipper and crew at all times — the skipper has final authority over the vessel and its route for safety reasons

  • Not to bring prohibited substances, dangerous items, or pets on board unless explicitly agreed in advance

  • To treat the vessel, its equipment, and the crew with respect

  • To pay for any damage caused to the vessel or equipment beyond normal wear and tear

Valid identification documents are required at the time of charter for all guests in certain circumstances. Specific requirements will be communicated at the time of booking.

Liability

Our liability

Where we act as broker, our liability is limited to the proper arrangement and coordination of your booking, and to the amounts effectively received by us. We are not liable for the acts or omissions of vessel operators, skippers, crew, or other third parties involved in the delivery of your charter.

Where we act as principal, our liability is governed by the Hire Conditions.

In all cases, nothing in these Terms excludes or limits liability that cannot be excluded or limited under Spanish consumer law.

Force majeure

We are not liable for failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including but not limited to adverse weather, vessel mechanical failure, port authority restrictions, or acts of nature.

In circumstances where a charter cannot proceed due to force majeure, we will work in good faith to find a suitable alternative date or arrangement.

Weather and sea conditions

The skipper / captain has sole authority to determine whether conditions are suitable for departure. If the skipper considers conditions unsafe, the charter may be postponed or curtailed. In such cases, the protections set out in the Hire Conditions apply.

Privacy and cookies

Your use of the Site is also subject to our Privacy Policy and Cookie Policy, which describe how we handle personal data and use cookies.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Entire agreement

These Terms, together with the Hire Conditions and your booking confirmation, constitute the entire agreement between you and us in relation to your charter and supersede any prior agreement, communication, or representation, written or oral.

Governing law

These Terms are governed by the laws of Spain. Any disputes shall be subject to the jurisdiction of the courts of Ibiza, Spain — without prejudice to any mandatory consumer protection rules that may grant you the right to bring proceedings in the courts of your place of residence.

Changes to these terms

We may update these Terms from time to time. The version displayed on the Site at the time of your booking applies to that booking. The date at the top of this page reflects the most recent update.
